Belfort family seeks judicial review of Circuito Nacional Belfort case after 17 years off the air

Shareholders of the defunct radio network hope a potential Supreme Court restructuring will reopen proceedings regarding the restitution of their broadcasting licenses.

Shareholders and heirs of the Circuito Nacional Belfort radio network have called for the reopening of judicial proceedings regarding the revocation of their broadcast licenses, an administrative decision enacted by regulatory authorities seventeen years ago.

According to the consulted source, Luis Miguel Belfort, shareholder and heir of the media group, stated that the family hopes a potential restructuring of the Supreme Tribunal of Justice will allow for a reassessment of administrative rulings issued in 2009. Belfort maintained that the network complied with all required procedures following the death of the original license holder in 2000, asserting that the administrative process resulting in their removal from the airwaves denied them proper defense rights and due process.

The dispute dates back to July 2009, when the Ministry of Public Works and Housing and the telecommunications regulatory agency terminated the network's broadcast concessions in several Venezuelan cities, including Caracas, Valencia, San Cristóbal, Punto Fijo, and Maracaibo. Records from the Political-Administrative Chamber of the Supreme Tribunal show that the heirs challenged the ministerial resolutions; however, the court rejected requests for injunctive relief to remain on the air, concluding that hereditary preference rights did not apply to broadcasting titles.

To date, judicial bodies and telecommunications regulators have issued no formal rulings or public statements regarding a review of the closed files. The former operators maintain that any eventual reconsideration should examine the recovery of the frequencies alongside potential compensatory evaluations.

Luis Miguel Belfort is a Venezuelan broadcaster and shareholder of Circuito Nacional Belfort, representing three generations in the country's commercial radio sector. Circuito Nacional Belfort was a Venezuelan radio broadcasting company established in the 1990s that operated ten proprietary stations and multiple affiliated broadcasters across the country until regulatory measures forced its operations to halt in 2009.
